CG- High Court's decision in favor of female candidate regarding TET case in teacher recruitment, order given to the department to get her joining.

Raipur 9 December 2023. The female candidate who was made ineligible in teacher recruitment has got a big relief from the High Court. The High Court has given its verdict in favor of the candidate and has given the decision to join the petitioner on the post of teacher in Bastar division. Actually, the Director, Directorate of Public Instruction, Raipur issued an advertisement for recruitment to the post of Teacher in Bastar and Surguja Division in the year 2023. Manisha Thakur, resident of Deendayal Nagar, Rajnandgaon, had applied for recruitment to the post of teacher in Bastar division.

After the entire recruitment process, she was selected in the examination, but on 30 September 2023, Manisha Thakur was made ineligible by the Joint Director, Education Division, Bastar on the grounds that her TET. The validity of the certificate has expired. Angered by the said order, a writ petition was filed before the High Court Bilaspur by Manisha Thakur through High Court advocates Abhishek Pandey and Durga Mehar.

 This argument was presented before the High Court by advocates Abhishek Pandey and Durga Mehar that earlier the validity of Teacher Eligibility Test (TET) was made for seven years. But, on 09.06.2021, TET was announced by the National Council for Teacher Education (NCTE). The validity of the examination was made lifelong, after that on 26 June 2021, Chhattisgarh Government issued a circular making the validity of the Teacher Eligibility Test (TET) examination lifelong.

 Since the petitioner appeared for TET in the year 2011. The exam has been passed. Therefore, under the circular issued by NCTE and Chhattisgarh Government in June 2021, the petitioner's TET. The validity of the certificate is lifetime, hence she is eligible for recruitment to the post of teacher. After hearing the said writ petition, the High Court, Bilaspur accepted the writ petition and directed the Director, Directorate of Public Instruction, Raipur and Joint Director, Education Division, Bastar to resolve the petitioner's representation on the basis of the above mentioned circular. Please provide joining to the petitioner on the post of teacher in Bastar division.
